For the purpose of the Data Protection Act 1998 pursuant to the General Data Protection Regulation (GDPR)

Triumph Commercial Services Ltd t/a Mercian Leasing are committed to protecting and respecting your privacy.  We are a data controller.  Definition “data controller” means a person/business who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be controlled.

This policy sets out the basis on which any personal data we collect from you, or that you may provide to us, will be controlled by us.  Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. Should you have any objections to us holding your data or issues with our policy can you please address them to datacontroller@mercianleasing.co.uk.  If we do not hear from you we will assume you have accepted our policy below.

Information we may collect from you

We may collect the following data about you for the purpose of brokering and or providing a quote or giving a guarantee.

Information you give us.

You may give us information to us by phone, e-mail or otherwise. The information you give us may include your name, address, e-mail address and phone numbers, business details, bank account details, credit history, asset details, your finance requirements.  Also we will also ask for your authority for one or more finance house or bank to carry out a credit searches and these will be conducted in your name and in your business name.  You may also be asked if you able to give permission for the same finance house or bank to carry out credit searches against other directors, business owners or partners within the same business.

Information we receive from other sources.

We may receive information about you or your company from Experian and Operators Licence Search. 

Uses made of the information

We use information held about you in the following ways:

So that we may provide our brokering services to you for example, Hire Purchase agreements and Lease agreements, Commercial Loans, Factoring Facilities and any other services we are able to offer.

To provide your data to selected party finance houses or banks.  Who will undertake credit checks to establish a credit rating and also to prevent and detect crime.

So that we can fulfil our legal and regulatory obligations, we may be required to confirm identification and proof of home address to help prevent crime.

To comply with our legal and regulatory obligations, for example, to report to regulators and authorities about the products and services we provide to you.

To protect and defend our legal rights.

To provide you, with information on services we feel may interest you. If you are an existing customer, we may contact you by telephone, letter or electronic means (e-mail or text) with information about goods and services similar to those which were the subject of a previous agreement.

To notify you about changes to our service

Information we collect about you.

We will use this information:

as part of our efforts to keep our site safe and secure;

to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you;

to make suggestions and recommendations to you and other users of our services about goods or services that may interest you or them.

Information we receive from other sources. We may combine this information with information you give to us and information we collect about you. This combined information will help us provide with the best possible service.

Disclosure of your information

We may share your personal information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

Our in house advertising may require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with your name and email address.  The information we provide to a 3rd party advertising company will be for our own use only and will not be used by anyone else.

We may disclose your personal information to third parties:

In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

If Mercian Leasing or substantially all of its assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation.  This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

 

All information you provide to us is stored on our secure servers. We also keep a paper copy of your information.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted via email; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

 

Your right of access to your personal data

 

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.  The information held will be provided within one month of receipt of your request.  This may be extended depending on the amount of data we hold.  You will be asked to provide us with information to verify your identity before providing you with the information requested.  We do not even with your permission pass on your data to any 3rd party.  This should be done at your own risk and cost.

 

Your right to rectify any personal data we hold

 

You have the right to have any personal data that we hold about you corrected if it is wrong or incomplete.

 

Your right to be forgotten

 

You have the right to be forgotten unless the data we hold is to comply with any legal obligation to which we are subject to.  This may include but not limited to the Financial Conduct Authority.  We will also ensure that your request is passed onto any 3rd parties whilst we were controlling your data for your application.

 

Your right to have controlling or processing of your personal data restricted

 

In some instances you have the right to have the controlling or processing of your personal data restricted.  You will have the right

 

If you advise us that your personal data is incorrect, for a period enabling us to verify its accuracy; or

 

If we are not controlling your personal data lawfully and you tell us that you rather have us restrict the processing than erase it; or

 

We no longer need your personal data but you need us to store is because you need it for the establishment, exercise or defence of legal claims; or

 

If you have objected to us controlling your personal data, for a period enabling us to verify whether the legitimate grounds on which we are processing it overrides your grounds for objection

 

This is not an absolute right, and your personal data may still be controlled by us where certain grounds exist.  This is:

For the establishment, exercise, or defence of legal claims;

 

For the protection of the rights of another natural or legal person;

 

For reasons of important public interest.

 

Changes to our privacy policy

 

Any changes we may make to our privacy policy in the future will be notified to you by e-mail. Where no email is held on file we will notify you in writing using Royal Mail 2nd class.
